These Terms of Service Use are effective as of July 16, 2006.

AdviceParty.com is an online system that allows users to post personal situations in order to have it voted on by the public. AdviceParty.com service is operated by the AdviceParty.com network, ("AdviceParty.com"). By using the AdviceParty.com web site (the "Web site") you agree to be bound by these Terms of Use (this "Agreement"), whether or not you register as a member ("Member"). We reserve the right, at anytime, to change, modify, add or delete sections of these Terms of Use at any time without further notice. If we do this, we will post the changes on this page and will indicate at the top of this page the Terms of Use's effective date. Your continued use of the Web site after any changes constitutes your acceptance of the new Terms of Use Agreement. Eligibility

In order to register as a member you must be thirteen years of age or older. If you are under the age of thirteen, you are not allowed to register as a member of AdviceParty.com or access AdviceParty.com content. AdviceParty.com holds the right to terminate your membership for any reason, at any time without warning. You are solely responsible for all content published or displayed through your personal account, including photos, personal messages and or interactions with other members. Membership in the Service is void where prohibited. By using the web site, you represent and warrant that you agree to and abide by the terms and conditions of this Agreement.

Disclaimers

AdviceParty.com is not responsible for any incorrect or inaccurate Content posted on the Website or in connection with the Service provided, whether caused by users of the Website, Members or by any of the equipment or programming associated with or utilized in the Service. AdviceParty.com is not responsible for the conduct, whether online or offline, of any user of the Website or Member of the Service. AdviceParty.com assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any user or Member communication. AdviceParty.com is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or players due to technical problems or traffic congestion on the Internet or at any Website or combination thereof, including any injury or damage to users and/or Members or to any person's computer related to or resulting from participation or downloading materials in connection with the Website and/or in connection with the Service. Under no circumstances shall AdviceParty.com be responsible for any loss or damage, including personal injury or death, resulting from use of the Website or the Service or from any Content posted on the Website or transmitted to Members, or any interactions between users of the Website, whether online or offline. The Website and the Service are provided "AS-IS" and AdviceParty.com expressly disclaims any warranty of fitness for a particular purpose or non-infringement. AdviceParty.com cannot guarantee and does not promise any specific results from use of the Website and/or the Service.

Member Conduct

You understand the Web site is only intended for the personal use of Members and may not be used in connection with commercial endeavors except those that are approved by the management of AdviceParty.com. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from member profiles without warning and may result in termination of membership privileges without warning. You agree that no materials of any kind submitted through your account will violate or infringe upon the rights of any third party, including copyright, trademark, privacy or other personal or proprietary rights; or contain libelous, defamatory or otherwise unlawful material. You further agree not to harvest or collect email addresses or other contact information of members from the Web site by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications. Additionally, you agree not to use automated scripts to collect information from the Web site or for any other purpose. You further agree that you may not use Web site in any unlawful manner or in any other manner that could damage, disable, overburden or impair Web site.

Member Content Posted

You are solely responsible for the content that you publish (hereinafter, "post") on the Service, or transmit to other Members (collectively the "Member Content"). All member questions that are submitted will be reviewed before being active on the Website. Any question which has vulgar language, distasteful subjects, advertising or just incomplete will be rejected from the Website. You understand and agree that AdviceParty.com may review and delete or remove any Member Content. By posting Member Content to any part of the Web site, you automatically grant, and you represent and warrant that you have the right to grant, to AdviceParty.com an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to use, copy, perform, display, reformat, translate, excerpt (in whole or in part) and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing. You may remove or edit your Member Content from the site at any time.

You may not post, distribute, or reproduce copyrighted material in any way, without obtaining written consent of the owner of such proprietary rights. If you believe your work has been copied in a way that constitutes copyright infringement or are aware of any infringing material on the Web site, please contact us at copyright@AdviceParty.com and provide us with the following information: an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; a description of the copyrighted work that you claim has been infringed; a description of where the material that you claim is infringing is located on the Web site; your address, telephone number, and email address; a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Limitation on Liability

IN NO EVENT SHALL AdviceParty.com BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE WEB SITE OR THE SERVICE, EVEN IF AdviceParty.com HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, AdviceParty.com.S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO AMOUNT PAID, IF ANY, BY YOU TO AdviceParty.com FOR THE SERVICE DURING THE TERM OF MEMBERSHIP.

Indemnity

You agree to indemnify and hold AdviceParty.com, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above.

Other

These Terms of Use constitute the entire agreement between you and AdviceParty.com regarding the use of the Web site and/or the Service, superseding any prior agreements between you and AdviceParty.com relating to your use of the Web site or the Service. The failure of AdviceParty.com to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
